Terms and Conditions
The SPA Pitch on Demand Initiative (the “Initiative”) is administered and hosted by Screen Producers Australia (“SPA,” “we,” or “us”). The following terms and conditions apply to all persons and organisations who participate in the Initiative
STRUCTURE
Each participating commissioning executive (Commissioner) will;

Provide a Commissioning Brief which may be delivered as a published brief document, a video webinar, or both of the above.

On their behalf, allow SPA to collect Pitch Materials via a submission portal.

Select a number of finalists who will be given the opportunity to pitch their project directly to the Commissioner.
ELIGIBILITY
The Commissioning Briefs are available to anyone who registers to participate via the links provided by SPA. SPA reserves the right, at its absolute discretion, to restrict specific people from accessing the Commissioning Briefs or submitting materials for the benefit of the initiative.
The submission of Pitch Materials is open to SPA Members who are full financial members on October 14th, 2024. Employees of SPA are not eligible to submit Pitch Materials.
SPA Members may submit a maximum of one (1) pitch document for each Commissioning Brief Submission of your completed Registration and at least one (1) original pitch document (the “Pitch Materials”) via the Pitch On Demand website which is hosted at https://spa.swoogo.com/pod (The Website) entitles you to participate in the initiative and shall constitute your entry (“Entry”) and acceptance of these terms and Conditions.
Entry must be complete and comply with the format, structure and content guidelines instructed on the Website.
SPA is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations or entries, which will be disqualified. Any entrants deemed ineligible will not be considered for assessment and will not be notified of their exclusion from the initiative.
Feedback will not be provided for individual applicants.
Being selected as a finalist does not guarantee the participant funding or ongoing support of any kind.
The Initiative is subject to all applicable laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Terms and Conditions (the “T&Cs”) and SPA’s and the Commissioner’s decisions, which are final and binding in all matters related to the Initiative.
TIMING
The Initiative begins on 27th August 2024 at 12:00 am AEDT and ends on 21st November, 2024 at 11:59 pm AEDT (the “Initiative Period”).
SELECTION
If requested by the Commissioner, there will be one round of assessment by SPA representatives where a recommended shortlist of projects will be selected (the “Shortlist”). The shortlist will be created based on SPA’s view of the strength of the pitch, the projects viability, and the synergy of the project with the Commissioning Brief. The commissioner will then be provided with the Shortlist and all eligible Entries for consideration in selecting a final list of projects to proceed to the pitch stage (the Finalists). If the Commissioner does not request SPA to produce a Shortlist, they will only be provided with all eligible entries.
The Commissioner will, at their total discretion select a list of Finalists who they agree to meet with via video call for the purposes of receiving a final Pitch
By entering, each participant agrees to: (a) comply with and be bound by these Rules and the decisions of SPA and the Commissioner, which are binding and final in all; (b) release and hold harmless SPA from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, infringement of trademark, copyright or other intellectual property rights arising out of or relating to a participant’s Entry
REPRESENTATIONS AND WARRANTIES
You hereby warrant and represent the following:

The Pitch Materials must be your original creative work or be based on a work in the public domain, and you hereby warrant and represent that you are the sole and exclusive owner of all right, title, and interest in and to the Pitch and/or have obtained prior written authorisation or license to submit the Pitch from any and all third-party rights holders therein.

Your Pitch Materials will not infringe, misappropriate or violate the intellectual property, privacy or other rights of any third party; and/or you have obtained prior written authorisation to act on behalf of any co-creators of the Pitch Materials;

Submission of the Pitch , will not conflict with or violate any term or condition of any other agreement to which you are a party;

You have the right, authority, and capacity to enter into this agreement, and you agree to abide and be bound the terms and conditions herein.
You herby agree to the following:

You are solely responsible for protecting your rights in the Pitch Materials.

The Commissioners regularly receive submissions and there is a possibility that your project may bear similarities to existing or future projects the parties may be involved with;

Pitch Materials may be provided to external assessors by SPA in order to assist with the assessment.

SPA may publish details about your project online and in printed materials for the sole purpose of promoting the Initiative.
